¶1Heard learned counsel appearing for the petitioner and learned Standing Counsel for the Respondents No.1, 2 & 3.

¶2In view of proposed order notice to Respondent No.4 is dispensed with.

¶3Learned counsel appearing for the petitioner has submitted that petitioner is working on the post of Assistant Teacher in Kissan Vaidik Junior High School Latifpur, Gautam Budh Nagar. It has further been submitted that petitioner after completion of 10 years of service was granted selection grade w.e.f. 26.09.2007.

¶4Learned counsel appearing for the petitioner has invited attention of this Court that since after grant of selection grade petitioner has already completed more than 12 years of service which is required for grant of promotional pay-scale therefore, petitioner is entitled for promotional pay-scale.

¶5Learned counsel appearing for the petitioner has also invited attention of this Court towards the fact that petitioner has already made a representation to District Basic Education Officer, Gautam Budh Nagar on 11.09.2023 but till date, petitioner's grievance has not been redressed.

¶6On the other hand, learned Standing Counsel for the Respondents No.1, 2 & 3 has very fairly submitted that once petitioner has submitted representation, the ends of justice should be served if a direction is issued by this Court to District Basic Education Officer, Gautam Budh Nagar to consider and decide the petitioner's representation within a fixed time framed.

¶7In view of the aforesaid submissions advanced by the learned counsels appearing for the parties, this writ petition is finally disposed of with liberty to petitioner to file a fresh representation within three weeks from today and if such representation is filed, Respondent No.2 is directed to consider and decide the said representation by passing speaking and reasoned order within a period of two months thereafter.
