¶1Heard learned counsel for the parties.

¶2Petitioner is claiming promotion from Chief Medical Superintendent which is rank of Assistant Professor to the post of Professor as he is currently working at Maharani Laxmi Bar Medical College, Jhansi.

¶3He submits that on account of a criminal case instituted against him in which he is facing trial, his claim for promotion has not got due consideration. He further submits that the petitioner has already represented the matter before respondent no.2 on 01.10.2022 but the same has not been decided till date.

¶4Learned Standing Counsel submits that such a representation regarding claim for promotion could be considered provided there is a sealed cover procedure adopted as per relevant rules.

¶5Be that as it may, this petition stands disposed of with direction that the claim of the petitioner will be considered and will be strictly adhered to the rules prescribed for promotion and his claim be disposed of within a period of two months of production of certified copy of this order.
