In deference to the order dated 06.10.2023, card notice was issued to the petitioners. As per office report, card notice sent to the petitioner no.1/1 has returned back with the remark 'recipient is in Mumbai'. Hence service of card notice upon petitioner no.1/1 is not sufficient. Card notice issued to the petitioner no.2/1 and 2/2 has returned back with the remark 'refused to accept'. Hence service of card notice upon 2/1 and 2/2 is sufficient. Card notice sent to the petitioner nos.3,4 and 7 has returned back with the remark that 'recipient is dead'.Card notice sent to the petitioner nos. 5,6 and 8 has not returned back. Hence service of notice is sufficient. No other address of the petitioner no.1/1 has been provided in the petition and none has also put in appearance on his behalf. Thus it appears that the petitioners are not interested in pursuing the matter. Dismissed accordingly. Interim order, if any, stands vacated.
