This review application is filed to review the judgment and order dated 07.03.2022 passed in Writ 'A' No.1857 of 2019 (Smt. Sarita Vs. State of U.P. and others). Facts noted in the said order dated 07.03.2022, are that Smt. Sneh Lata was placed at Sl. No.1 and the petitioner of the said writ petition was placed at Sl.No.2 in the merit list for appointment on the post of Mini Anganwadi Karyakattri for Village Panchayat Indalpur, Block Jahangirganj, District Ambedkar Nagar. Since Smt. Sneh Lata refused to accept the offer of appointment, hence the petitioner Smt. Sarita being at Sl.No.2 ought to have been offered appointment. This Court after hearing directed the respondent no.5/Chief Development Programme Officer, Block Jahangirganj, District Ambedkar Nagar to proceed with the matter and issue appointment letter to the petitioner as per the merit list, if there was no other legal impediment. Now, the review applicant Smt. Manju Devi has approached this Court. Along with the supplementary affidavit, she has filed an order dated 25.03.2017 of the Child Development Programme Officer which also contains the merit list and as per the merit list noted in the said order the review applicant got the same marks similar to one who was offered appointment. Learned counsel for the review-applicant states that Smt. Sneh Lata was older in age than the review applicant and, hence, she was given the appointment and after her it is the review applicant who should be given the appointment. It is stated by the review applicant that till date decision is not taken by the Child Development Programme Officer, Block Jahangirganj, District Ambedkar Nagar in furtherance of the order dated

07.03.2022 passed by this Court and the matter is still pending. In the given facts and circumstances of the case, review applicant is also permitted to move an application before the Child Development Programme Officer, Block Jahangirganj, District Ambedkar Nagar, who shall take a decision in furtherance of the order of this Court dated 07.03.2023 forthwith, after hearing both the parties i.e. petitioner, review applicant and the one third person; namely, Smt. Poonam Devi wife of Sri Rajendra Prasad, who also obtained the same marks as the review applicant, in accordance with law, unless there is any legal impediment. With the aforesaid observations and the directions, the review application stands disposed of. (Vivek Chaudhary,J.)
