Heard Sri Anil Kumar Mishra, learned counsel for the applicant and Sri Sandeep Kumar, learned counsel for the opposite party no. 2. Learned counsel for the parties contend that the parties have arrived at a compromise which has been reduced to writing and the opposite party no. 2 does not want to press the prosecution. The compromise has been verified by the learned trial court. In this wake the entire criminal proceeding of S.T. No. 1742 of 2022 Case Crime no. 590 of 2020 under Sections 323, 504 IPC and Section 3(1) (D) SC/ST Act, Police Station Madion, District Lucknow arising out of chargesheet dated 23.09.2020 is hereby quashed. The application is allowed. However, the opposite parties are directed to deposit the compensation received from the State Government if any on account of the instant offence within a period one month and in case such amount is not deposited within the aforesaid period of one month the District Magistrate shall recover the amount from the opposite party no. 2 as arrears of land revenue. The Chief Judicial Magistrate, Lucknow shall require the District Magistrate to submit a compliance report of the recovery of the aforesaid amount within a period of three months from today and send the said report to the Registrar General of this Court.
