¶1Heard learned counsel for petitioners and Mr. Uttam Kumar, learned State Counsel appearing on behalf of opposite parties.

¶2Petition has been filed challenging orders dated 05.12.2022 and 07.12.2022 whereby their claim for promotion in Level II and Level III with effect from the date of promotion of their juniors in the U.P. Provincial Medical and Health Services Cadre has been refused to rejecting their representations. Further prayer for their promotion with effect from the date when juniors have been promoted has also been sought.

¶3Learned State counsel on the basis of instructions has submitted that vide order dated 03.10.2023, a copy of which is taken on record, petitioners' have already been granted notional promotion with effect from 19.08.2014.

¶4Learned counsel for petitioners after perusal of impugned order does not dispute the same.

¶5In view of aforesaid, nothing more is required to be adjudicated upon this petition, which is accordingly consigned to record without adversely affecting benefit already granted to petitioners. Order Date :- 31.10.2023 Subodh/- High Court of Judicature at Allahabad, Lucknow Bench
