The present matter has been repeatedly listed under Chapter 12 Rule 4 of the Allahabad High Court Rules, 1952. On 27.09.2023, the Court had passed the following order which reads as under:- "The present matter is listed under Chapter 12 Rule 4 of the Allahabad High Court Rules, 1952. In compliance of the order dated 17.08.2023, the learned counsel for the appellant was directed to serve the respondent no. 2 by registered post, however, as per the office report, the steps have yet not been taken. In the interest of justice, a week's time is granted to the learned counsel for the appellant to take steps in compliance of the earlier order. In case if the steps are not taken within the aforesaid period, the matter shall be listed under the appropriate heading immediately after the expiry of the aforesaid period." Today again, the matter is listed under Chapter 12 Rule 4 of the Allahabad High Court Rules, 1952 and as per the office report, the steps have not been taken. In view of the aforesaid, the appeal is dismissed in terms of Chapter 12 Rule 4 of the Allahabad High Court Rules, 1952.
