Judgment
Court No. - 9 Case :- CRIMINAL MISC. WRIT PETITION No. - 4399 of 2023 Petitioner :- Smt. Sudha Mishra And Another Respondent :- State Of U.P. Thru. Prin. Secy. Home Civil Secrett. Lko. And 3 Others Counsel for Petitioner :- Rama Kant Dixit Counsel for Respondent :- G.A. Hon'ble Rajnish Kumar,J. Hon'ble Umesh Chandra Sharma,J. Heard learned counsel for the petitioner and learned A.G.A. This petition has been filed for a writ of mandamus commanding the opposite parties not to create any hindrance/interfere/harass in peaceful married life of the petitioners. Submission of learned counsel for the petitioners is that the petitioners are major and they have solemnized their marriage on their own sweet Will and are living together but they have a threat from the father of the petitioner no.1 of ruining their life. Perusal of the petition indicates that several allegations have been levelled against the petitioner no.1, whereas the petitioner no.1 who is present in Court alongwith the petitioner no.2 on a query being put, does not support those allegations and also failed to indicate any eminent danger to the life of the petitioners. Even otherwise, if there is any threat to the petitioners, they have a remedy under Section 154, 156(3) and 200 of the Court of Criminal Procedure, which may be availed by the petitioners in accordance with law. In view of above this petition is mis-conceived and lacks merit. It is accordingly dismissed. . (Umesh Chandra Sharma,J.) (Rajnish Kumar,J.)
