Transfer Application No. 12 of 2023 (Under Clause 14 of United Provinces High Court (Amalgamation) Order of 1948) The instant application has been filed seeking transfer of Writ C No. 28526 of 2021 along with connected matters from the Lucknow Bench to the High Court of Judicature at Allahabad. Learned counsel for the applicant submits that the present writ petition was initially filed at the Principal Seat of this Court at Allahabad and on 26.11.2020, it was heard and an interim order in respect of operation of Bank Account of Mary Lucas School & College, Prayagraj was passed. Thereafter, a modification application was filed, being Civil Misc. Modification Application No. 6 of 2020 in Writ-C No. 17887 of 2020, wherein, an order dated 12.11.2021 was passed by a learned Single Judge of this Court sitting at Lucknow (through video conferencing), directing the Registrar General of the Court to transmit and place all the connected writ petitions to this Court at Lucknow. In response to the order dated

12.11.2021, present writ petition along with Writ C No. 28524 of 2021, 28525 of 2021 and 28527 of 2021 were transferred to this Court at Lucknow from Allahabad. During the pendency of the aforesaid writ petitions, Special Appeal No. 265 of 2023, involving similar issues, has been filed before this Court at Lucknow. In view of aforesaid facts and circumstances of the case, I am of the opinion that it would be in the interest of justice if the present writ petition along with all connected matters, including Special Appeal No. 265 of 2023 be transmitted to the Principal Seat of this Court at Allahabad and be heard and decided together. Accordingly, the present writ petition along with all connected matters, including Special Appeal No. 265 of 2023, are transmitted to the Principal Seat of this Court at Allahabad.
