¶1Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

¶2Present application has been moved by the applicant with the prayer that the private respondent nos.2-5 may also be summoned in complaint case no.88 of 2017 "Smt. Soniya Vs. Awadesh Yadav and Others".

¶3Learned counsel for the applicant submitted that respondent no.6 is the land grabber and only with the intention to make pressure on applicant and his son for taking their property, rest of the respondents (Police OfÏcials) entered into the premises of the applicant on the best of respondent no.6, and thereafter, the complaint was made to Senior OfÏcers but no action was taken either against the Police OfÏcials/respondent nos.2-5 or against the respondent no.6, thereafter, application under Section 156 (3) Cr.P.C. was moved before the trial court and the same was treated as a complaint and after recording of the statement of applicant under Section 200 and 202 Cr.P.C, summoning order was passed only against the respondent no.6 excluding rest of the private respondents.

¶4On the basis of earlier order, instructions are placed by learned A.G.A. and inform that on the basis of incorrect facts, complaint was filed before the court below only with the intention to make pressure on the applicant and no such incident was taken place.

¶5Considering the submissions of learned counsel for the parties, going through the record, it is evident that applicant is having a video recording of the said incident, in such circumstances, the present application under Section 482 Cr.P.C. is disposed of with the liberty to applicant to move application before the Additional Director General of Anti Corruption Organization, U.P., Lucknow, within one month from today.

¶6In case, any application is filed, then Additional Director General of Anti Corruption Organization, U.P., Lucknow is directed to depute some responsible ofÏcer to conduct an enquiry about the allegation made in the complaint and submit a report to this Court by way of afÏdavit, within four weeks.
