The petitioner has approached this Court challenging the recovery certificate dated 25.09.2023 issued on the basis of the electricity bill. The petitioner has disputed the correctness of the same. Shri Manish Johari, learned counsel for the respondent-department states that the petitioner has an alternative remedy to place the dispute in regard to the correctness of the electricity bill under the provisions of clause 6.5 of the Electricity Code, 2005 before the Executive Engineer concerned respondent No.4. In the given circumstances, it is provided that if the petitioner raises such a dispute before the Executive Engineer respondent No.4 within 10 days from today, the Executive Engineer concerned shall decide the same by a reasoned and speaking order within two weeks. Recovery certificate issued against the petitioner shall be subject to the final order passed by the Executive Engineer. In case, the petitioner does not file objection within the aforesaid period of 10 days, the petitioner shall not be entitled for the benefit of this order.
