Learned counsel for the petitioner instead of filing the better affidavit has signed the affidavit, which could not have been done. Sri Zishan Ali,Advocate holding brief of Sri Sm Abdullah Husain, learned counsel for the petitioner prays for and is granted a week's time to file better affidavit in support of the petition and also disclose the status of the Regular Suit pending between the petitioner and the private respondent and also implead the State of U.P. as an opposite party by moving appropriate application on an objection raised by learned Standing Counsel as he is a necessary party. List after a week. It is made clear that mere filing of this petition at this stage will not give any right or benefit to the petitioner. " Shri Zishan Ahmad, Advocate holding brief of Shri S.M. Abdullah Husain, learned counsel for the petitioner prays for dismissing this petition as not pressed with liberty to file fresh as the petitioner could not come to file the supplementary affidavit. To which there is no objection by the other side.
