Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 5924 of 2023 Petitioner :- Vishram Respondent :- Ranvijay Pratap Singh And Others Counsel for Petitioner :- Prashant Shukla Counsel for Respondent :- Ravindra Pratap Singh Hon'ble Rajnish Kumar,J. Heard Shri Prashant Shukla, learned counsel for the petitioner and Shri Ravindra Pratap Singh, learned counsel for the respondents. This Court had passed the following order on 05.12.2023:- Sri Ravindra Pratap Singh, learned counsel has filed Vakalatnama on behalf of opposite party nos.3 and 4 which is taken on record. He raises two preliminary objections, first of which is that petitioner has already received and accepted the cost of Rs.200/- imposed by means of the impugned order dated 23.10.2023, therefore, he cannot assail the order because he cannot accept the order in part. Second objection is that the impugned order is revisable therefore, the petition under Article 227 is not maintainable. Reliance is placed on the judgments of High Court of Punjab and Haryana in case of Amar Singh vs Perhlad and others; 1989 AIR (P&H) 229 and of Allahabad High Court in case of Prashant Kumar vs Triveni Infrastructure Development Company and 5 ors; 2018 (36) LCD 615. Learned counsel for the petitioner seeks 24 hours time to prepare and argue. List on 07.12.2023 in terms of earlier order passed by this Court. Learned counsel for the petitioner fairly submits that he could not get any law that after receipt of the cost the petitioner can challenge the order. In view of above, this petition is misconceived and lacks merit. It is, accordingly, dismissed. ...................................................................(Rajnish Kumar, J.)
