The petitioner seeks a writ of mandamus to opposite party no.1 for appointing the Chief Executive Officer of U.P. Shia Central Waqf Board of Waqf for which it is competent under Section 23 of the Waqf Act, 1995 as amended from time to time. If there is no legal impediment, let opposite party no.1 take a decision in the matter at the earliest say within three months. Once the Chief Executive Officer is appointed, he shall consider and decide the application of the petitioner which is said to be pending as referred in relief no.(ii), at the earliest and as per law.
