Judgment

Court No. - 6 Case :- MATTERS UNDER ARTICLE 227 No. - 6216 of 2023 Petitioner :- Agnoo Respondent :- State Of U.P. Thru. Addl. Chief Secy. Revenue Lko. And Another Counsel for Petitioner :- Saurabh Kumar Counsel for Respondent :- C.S.C. Hon'ble Rajnish Kumar,J. On an objection raised by learned Additional Chief Standing Counsel that the petitioner has wrongly impleaded the State of U.P. through the Additional Chief Secretary, Revenue, Lucknow in this petition because he has no concern with the Regular Suit No.219 of 2018, disposal of which in a time bound manner has been sought, in the present petition. Learned counsel for the petitioner submits that the State of U.P. has wrongly and inadvertently been impleaded and he may be permitted to delete the respondent no.1 from the array of the parties and delete No.2 from respondent no.2. Learned counsel for the petitioner is permitted to delete the respondent no.1 from the array of the parties and delete No.2 from respondent no.2. Shri Saurabh Kumar, learned counsel for the petitioner submits that the respondent has filed Regular Suit No.219 of 2018. After filing of the objection by the petitioner he is not appearing, therefore the case is being adjourned repeatedly. Whereas perusal of the order sheet indicates that the plaintiff is appearing regularly since last many dates except on the dates when the Lawyers were on strike, therefore the contention of learned counsel for the petitioner is misconceived and no direction can be issued by this court at this stage. Even otherwise the request in this regard showing urgency can be made before the concerned court only and the concerned court may consider the same in accordance with law. The petition is dismissed. . .. .................................... (Rajnish Kumar,J.) Order Date :- 13.12.2023 Banswar High Court of Judicature at Allahabad, Lucknow Bench
