Judgment
Court No. - 9 Case :- CRIMINAL APPEAL U/S 372 CR.P.C. No. - 128 of 2023 Appellant :- Patan Deen (Now Died) Thru. Ram Pal Verma Respondent :- State Of U.P. Thru. Secy. Home Deptt. Lko. And 3 Others Counsel for Appellant :- Rakesh Kumar,Arun Kumar Counsel for Respondent :- G.A. Hon'ble Rajan Roy,J. Hon'ble Ajai Kumar Srivastava-I,J. The appeal in the name of Patan Deen, the informant, who has died is not maintainable in the present format. In fact, the person on whom the attempt to murder is alleged to has been committed is the son of Patan Deen, namely, Ram Pal Verma, therefore, he would be the victim for preferring an appeal against acquittal under Section 372 Cr.P.C. and not Patan Deen, who has already died. The appeal is accordingly dismissed with liberty, however, as far as it may be permissible in law, for Ram Pal Verma to prefer such appeal. Office is directed to return the original documents annexed with the appeal to learned counsel for the applicant as per rules of the Court, after retaining a photocopy of the same on record.
