¶1Heard learned counsel for the applicant and learned A.G.A. for the State.

¶2The present application under Section 482 Cr.P.C. is filed with the prayer to quash the proceeding of the Case No.145221/2023, State Vs. Shabib Haider", in Case Crime No.614/2023 under Sections 381, 411, 420, 406 I.P.C., Police Station Thakurganj, Lucknow, pending in the court of A.C.J.M. (C.B.I.), Lucknow.

¶3Learned A.G.A. raised preliminary objection that compromise is executed in between the wife of the applicant and private respondent, which is not permissible.

¶4Learned counsel for the applicant wants to withdraw the present application with liberty to file afresh.

¶5Accordingly, the present application under Section 482 Cr.P.C. is dismissed as withdrawn, with the liberty, as prayed for.
