Judgment

Court No. - 6 Case :- WRIT - C No. - 11606 of 2023 Petitioner :- Devraj Yadav Respondent :- State Of U.P. Thru. Prin. Secy., Deptt. Of Revenue, Lucknow And Others Counsel for Petitioner :- Ashok Kumar Yadava Counsel for Respondent :- C.S.C.,Pankaj Gupta Hon'ble Rajnish Kumar,J. Heard Shri Ashok Kumar Yadav, learned counsel for the petitioner and Shri Upendra Singh, learned Additional Chief Standing Counsel. This petition has been filed challenging the order dated

03.09.2003, whereas the application for recall filed against the same is pending and also with a prayer to decide in the light of Section 67(A) of the U.P. Revenue Code-2006. The petition has also been filed without placing on record the copy of the order sheet of the application for recall. Even otherwise, the prayer no.1 for deciding the case in the light of Section 67(A) at this stage, when the application for recall is still pending is not maintainable, therefore this petition is misconceived. In view of above, learned counsel for the petitioner submits that this petition may be dismissed as not pressed with liberty to file fresh with proper prayer and pleadings. To which there is no objection by the learned Standing Counsel. Dismissed accordingly as not pressed with liberty as aforesaid. ...................................................................(Rajnish Kumar, J.) Order Date :- 22.12.2023 Haseen U.
