HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 12555 of 2025 Court No. - 15 HON'BLE KARUNESH SINGH PAWAR, J. Heard Sri Purnendu Chakravarty, learned Senior Advocate, assisted by Ms. Aishwarya, learned counsel for the accused-applicant as well as learned A.G.A. for the State and perused the record. In the prosecution case, it is alleged that on the basis of information received by the S.T.F. regarding the preparation of fake birth and death certificates and forged Aadhaar cards, a WagonR car was intercepted, in which the applicant was found seated on the driver's seat. Upon search of his bag, 40 currency notes of Rs. 500 denomination, amounting to Rs. 20,000/-, along with seven death certificates, were allegedly recovered. When the said certificates were verified through QR codes, they were found to be forged. Submission of the learned counsel for the applicant submits that the applicant is presently posted as a Gram Panchayat Adhikari. The alleged recovery is false, as there is no independent witness to the recovery, and there has been non-compliance with the provisions of Section 102 of the BNSS. It is further submitted that there is no electronic evidence or any report of a scientific expert whatsoever to establish the genuineness or otherwise of the alleged website or the alleged birth and death certificates. The applicant has no criminal antecedents, and the offences alleged are triable by a Magistrate. It has been further submitted that applicant has been languishing in jail since
31.10.2025 and, if facility of bail is granted, there is no apprehension that he will flee from the judicial process and he will abide by the orders passed by Versus Counsel for Applicant(s) : Pranjal Jain Counsel for Opposite Party(s) : G.A. Lal Bihari Pal .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s) the Court below and will co-operate in speedy trial of the case. Learned A.G.A. has opposed the prayer for bail but has not disputed the factual submissions made by the learned counsel for the accused-applicant. He submits that investigation is going in this case. On due consideration of facts that the applicant has been languishing in jail since 31.10.2025, he is a Government Servant, who is having no criminal history, the offences are triable by a Magistrate and the manner in which recovery has been done, I find it to be a fit case for enlarging the applicant on bail. Accordingly, the bail application is allowed. Let the applicant-Lal Bihari Pal, involved in Case Crime/FIR No. 175 of 2025, under Sections 318(4), 319(2), 336(3), 338, 340(2) BNS, Police Station-Cyber Crime, District-Lucknow, be released on bail on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:-
(i) the applicant shall not tamper with the prosecution evidence;
(ii) the applicant shall not pressurize the prosecution witnesses;
(iii) the applicant shall appear on each and every date fixed by the trial Court. Any other condition(s) which the trial court/concerned court may deem fit and proper, in the circumstances of the case, may also be imposed. It is clarified that the observations made in this order are confined to the present bail application and shall have no bearing on the merits of the trial.
