Case no.
CRL.M.C. 575/2026

Judgment

J U D G M E N T (oral)

¶1The matter has been released by the learned predecessor Bench.

¶2Learned counsel for both the parties are present.

¶3Heard.

¶4The point involved in the present petition is a very short one.

¶5In relation to FIR No.130/2024 registered at PS Lodhi Colony, accused Ajay Narain was held guilty by the learned Trial Court on 17.09.2019 and was convicted for offences under Sections 420 and 471 IPC, albeit, was acquitted for offence under Section 474 IPC. The order on sentence is dated

26.09.2019.

¶6The abovesaid accused challenged his conviction and order on sentence by filing an appeal, which was registered as CA No.551/2019.

¶7Feeling aggrieved by the acquittal of accused for offence under Section

474 IPC and also on the point of inadequate sentence for the other offences for which he had been held guilty, the concerned complainant also filed an appeal, which was registered as CA No.5/2021

¶8Evidently, the abovesaid appeals are pending for quite some time.

¶9Learned counsel for the petitioner submits that on various previous occasions, the arguments were heard at length and the matters were even reserved for judgment but there was no pronouncement of final order.

¶10It is submitted that both the abovesaid appeals are now coming up for consideration before learned First Appellate Court on 24.08.2026. It is also apprised that, in the interregnum, on account of transfer, the Presiding Officer of such Court has changed.

¶11The appeals are old as first such appeal was filed in the year 2019.

¶12Learned counsel for respondent No.2 submits that on 24th instant, he would not be available and would move appropriate application in this regard before the learned First Appellate Court but assures that thereafter, he would render full cooperation to the learned First Appellate Court so that the learned First Appellate Court is in a position to achieve expeditious disposal of the appeals in question.

¶13Learned counsel for both the parties thus assure that there would not be any delay or inaction on their part and would render their best assistance and cooperation to the learned First Appellate Court.

¶14Keeping in mind the overall facts of the case and the assurances given by the learned counsel for the parties, the present petition is disposed of with request to learned First Appellate Court to make best endeavour to dispose of the abovesaid two appeals as expeditiously as possible and, preferably, within a period of six months from the date these are taken up by the Court.

¶15The petition stands disposed of in aforesaid terms.

¶16A copy of this order be also sent to learned First Appellate Court for information and due compliance.
