¶1Allowed, subject to all just exceptions.

¶2The application is accordingly disposed of. W.P.(C) 5570/2023

¶3Vide the present petition, petitioner is seeking directions to the respondent no.2 to transfer/post the petitioner to any establishment at the BSF Headquarters, New Delhi or TC & STC BSF Hazaribagh so that he is able to be with his wife continuously and can get her treatments done.

¶4On the last date of hearing, i.e. on 01.05.2023, none appeared on behalf of the petitioner and same is the position today.

¶5In the interest of justice, we hereby dispose of present petition by directing the respondents to treat the present petition of the petitioner as a representation on his behalf and decide the same within four weeks. The decision so taken shall be communicated to the petitioner within one week thereafter with a reasoned order.

¶6Needless to say, if the petitioner feels aggrieved by the decision of the respondents on his representation, he may approach appropriate forum.
