¶1This application has been filed under Section 482 Cr.P.C. by the legal representatives of the petitioner Late Sh.Ranpal Singh seeking release of ₹5 lacs deposited by the petitioner Sh.Ranpal Singh in compliance of the directions of the order dated 8th February, 2008.

¶2Learned counsel for the applicants submit that since the petitioner Sh.Ranpal Singh has expired, being his legal representatives, the amount deposited by him in compliance of order dated 8th February, 2008 may be refunded to them. BAIL APPLN. 269/2008

¶3Order dated 8th February, 2008, in compliance of which the amount of ₹5 lacs has been deposited reads as under:-

"Bail Application No.269/2008

Notice, which is accepted by the learned APP.

On hearing learned counsels for the parties and taking into consideration the nature of the transaction as also the fact that the only reason cited for custodial interrogation is for recovery of ₹5.00 lakh given to the petitioner for renovation of the property and on the petitioner volunteering to depositing a sum of ₹5.00 lakh in Court within ten (10) days, I deem it appropriate to direct that the petitioner shall join the investigation and in case he is arrested he will be released on bail on furnishing a personal bond in the sum of ₹25,000.00 with one surety of the like amount to the satisfaction of the IO/SHO concerned.

Petition stands disposed of.

Dasti."

¶4It is clear from the above order that the amount of ₹5 lac was ordered to be deposited by the Court so as to protect petitioner Sh.Ranpal Singh from custodial interrogation. It cannot be refunded to the legal representatives as the recovery of the amount was claimed by the complainant.

¶5In view of the above, the application is dismissed.
