¶5Brief facts of the case are that the present FIR came to be registered pursuant to an accident which occurred on 04.08.2016 at about 9:40 a.m. near Kalkaji Bus Depot, Anand Mayi Marg Red Light, wherein the petitioner, while driving a scooter, allegedly collided with Respondent No. 2 and her mother-in-law, Ms. Anita Awasthi. As a result of the injuries sustained in the accident, Ms. Anita Awasthi unfortunately succumbed to her injuries. The petitioner was thereafter proceeded against for the offences arising out of the said accident.

¶6Learned counsel for the petitioner submits that during the pendency of the proceedings, the parties, with the intervention of their family members and well-wishers, amicably resolved their disputes and entered into a Settlement Deed dated 09.03.2024. It is further submitted that pursuant to the subsequent Memorandum of Understanding dated 11/12.04.2024, the petitioner paid a sum of Rs. 2,00,000/- to Respondent No. 4, husband of the deceased, towards full and final settlement of the claims and disputes between the parties.

¶7Respondent No. 2 is duly present before this Court and has been identified by the Investigating Officer as well as her learned counsel. Respondent No. 4, who is present through video conferencing, has also been duly identified by the Investigating Officer and his learned counsel.

¶8The Investigating Officer submits that the remaining two legal representatives of the deceased have given their No Objection in favour of Respondent No. 4, who is the husband of the deceased.

He further states that he has no objection if the present FIR and the proceedings emanating therefrom are quashed. Respondent No. 4 also has no objection to the quashing of the FIR.

¶10In view of the fact that the parties have amicably resolved their disputes and the legal representatives of the deceased have expressed their consent/no objection to the quashing of the proceedings, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in further litigation between the parties. This Court is, therefore, of the view that it would be in the interest of justice to bring the proceedings to an end.

¶11Accordingly, FIR No. 484/2016, registered at Police Station Okhla Industrial Area, Delhi, for the offences punishable under Sections 279/337/304-A of the IPC and Section 3/181 of the Motor Vehicles Act, 1988, along with all consequential proceedings emanating therefrom, is hereby quashed.

¶12The present petition stands disposed of. Pending application(s), if any, also stand disposed of.

¶13Copy of the order be communicated to the concerned Trial Court for necessary action and compliance.

¶14The order be uploaded on the website forthwith. MADHU JAIN, J AUGUST 24, 2026/ys/P The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
