¶1The present petition under Article 226 of the Constitution of India, 1950, seeks to grant the petitioner disability pension and ex gratia lump sum compensation from the date said benefits were due to the petitioner, i.e., his invalidation from service on the ground of physical unfitness till date of their release.

¶2Heard.

¶3Drawing support from the proceedings of the Medical Board, it is urged that the petitioner suffered depression because of aggravated service conditions.

¶4It is further urged that as such, the petitioner is entitled for disability This is a digitally signed order. pension and ex gratia payment, which is not yet adjudicated as the petitioner is admitted to regular pension only.

¶5In response to the aforesaid, learned counsel for the respondents, on instructions from Mr. Ajay Pal, Law Officer, states that the claim of the petitioner shall be looked into and adjudicated and the decision shall be communicated within a period of 12 weeks from today.

¶6The aforesaid statement is accepted.

¶7The petition as such stands disposed of accordingly.

¶8Pending application(s), if any, also stands disposed of.
