¶1This hearing has been done through hybrid mode.

¶2The present application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'BNSS') seeking regular bail in FIR No. 26/2026 registered at Police Station Cyber Cell, Delhi, under Sections 112(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS'). The petitioner has been in custody since 25.01.2026 and the investigation in the present case stands concluded and the chargesheet has already been filed.

¶3Learned counsel for the petitioner submits that the chargesheet in the present case already stands filed and that the petitioner has been in custody for the last about seven months. He further submits that the petitioner was earlier running a mobile shop and, therefore, some of the SIM cards recovered from his possession were unsold SIM cards which had remained with him The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. after he closed the shop. As regards the debit cards the learned counsel submits that out of the five cards allegedly recovered, three are in fact Metro cards and only two are debit cards. He further submits that out of the six cheques allegedly recovered, not all the cheques belong to the petitioner and some of them belong to his family members and relatives. It is submitted that none of the aforesaid recoveries, by themselves, establish the involvement of the petitioner in the alleged offence.

¶4Per contra, learned APP for the State submits that the petitioner is stated to be a member of a pan-India cybercrime syndicate and was involved in procuring mule bank accounts from account holders for receiving the cheated amounts from victims. He submits that after the arrest of the petitioner, his mobile phone was recovered and, upon analysis of the data therein, his involvement as an active member of the organised cybercrime syndicate has emerged. It is further submitted that the petitioner used to procure mule bank accounts and provide the details of such accounts for receiving the cheated amounts.

¶5Learned APP for the State further submits that the petitioner used to share the details of such bank accounts through his Telegram account and that, from the investigation conducted so far, one of the bank accounts shared through the Telegram account of the petitioner was found to be the subject matter of three NCRP complaints.

¶6Learned APP for the State submits that cyber fraud is on the rise and innocent persons are being deprived of their hard-earned money through such cyber frauds.

¶7This Court has considered the submissions made by learned counsel for the petitioner as well as learned APP for the State and has also perused the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. material placed on record.

¶8No doubt, the specific amount allegedly received through the account in question has not been mentioned in the complaint. However, considering the nature of the allegations, the material collected during investigation, including the alleged Telegram communications and the recoveries effected from the petitioner, as well as the magnitude and nature of the alleged cybercrime network, this Court is not inclined to grant regular bail to the petitioner at this stage.

¶9Accordingly, the present application is dismissed. Pending application(s), if any, also stand(s) disposed of.
