¶1Learned counsel for the plaintiff seeks to press prayer (b) to (d) against defendant no.1, which are in the following terms:

¶2The other prayers are withdrawn by the plaintiff.

¶3The learned counsel for defendant no.1 submits that prayer (b) & (c) already stand satisfied. He further submits that the defendant no.1 does not oppose prayer (d) as sought in the plaint. ¶4Learned counsel for the defendant no.1 undertakes, on instructions, that defendant No. 1 shall abide by the aforesaid statement.

¶5In the circumstances, with the consent of the learned counsel for the plaintiff and the learned counsel for the defendant no.1, the present suit is decreed in terms of prayer (b) – (d), qua the defendant no.1.

¶6The remaining prayers qua the other defendant/s stand withdrawn.

¶7The present suit stands decreed in the above terms. All pending applications also stand disposed of.
