¶1This hearing has been done through hybrid mode.
¶2By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the 'BNSS'), the petitioner seeks quashing of FIR No. 819/2020, registered at Police Station Dabri, for the offence punishable under Section 354 of the Indian Penal Code, 1860 (hereinafter referred to as the 'IPC'), along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties.
¶3Issue Notice. Learned APP for the state accepts notice on behalf of the state.
¶4The Petitioner and Respondent No.2 are present before this Court and have been identified by the Investigating Officer (IO) concerned. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
¶5Briefly stated, Respondent No.2 was married to the brother of the petitioner on 04.12.1995 in accordance with Muslim rites and customs. Owing to matrimonial discord and differences between the parties, disputes arose between Respondent No.2 and her matrimonial family members, pursuant to which Respondent No.2 lodged a complaint against her husband and his family members, including the present petitioner. Consequently, the present FIR came to be registered. After completion of the investigation, a charge-sheet was filed before the learned Trial Court. The other co-accused persons were subsequently discharged from the offences under Sections 498A/406/506/34 of the IPC and the petitioner is facing trial in respect of the offence punishable under Section 354 of the IPC. During the pendency of the proceedings, with the intervention of family members, well-wishers and respectable persons, the parties amicably resolved their disputes and executed a Settlement Deed dated 14.03.2026.
¶6Learned counsel for the petitioner submits that, in terms of the Settlement Deed dated 14.03.2026, the parties agreed to settle all their disputes for a total sum of Rs.13,00,000/- (Rupees Thirteen Lakhs only). It is submitted that a sum of Rs.8,00,000/- has already been paid to Respondent No.2 and the remaining amount of Rs.5,00,000/- (Rupees Five Lakhs only) has been handed over to Respondent No.2 today before this Court by way of Demand Draft bearing No. 552333. It is further submitted that, with the said payment, the terms and conditions of the settlement stand fully complied with and nothing further remains to be paid by either party under the settlement.
¶7On a query made by this Court, Respondent No.2, who has been duly identified by the Investigating Officer, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the petitioner. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.
¶8In view of the fact that the parties have amicably resolved all their disputes, the terms and conditions of the settlement have been fully complied with, the entire settled amount has been paid to Respondent No.2 and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. In the facts and circumstances of the present case, this Court finds no impediment in quashing the FIR and the proceedings emanating therefrom.
¶9Accordingly, FIR No. 819/2020, registered at Police Station Dabri, Delhi, for the offences punishable under Sections 354 of IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
¶10The present petition, along with pending application(s), if any, stands disposed of.
¶11Copy of the order be communicated to the concerned learned Trial Court for necessary action and compliance.
¶12The order be uploaded on the website forthwith. MADHU JAIN, J SEPTEMBER 1, 2026/JYH/P The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
