18.08.2026

¶1Petitioner herein is aggrieved by order dated 11.09.2024 whereby she had been asked to be present so that she is cross-examined by the defence.

¶2The grievance is for the reason that on various previous opportunities, the accused, for the reason best known to him, did not avail his right to cross-examine her.

¶3The next date of hearing before the learned Trial Court is stated to be

17.10.2026.

¶4After hearing arguments for some time and, without prejudice to his rights and contentions, learned counsel for the petitioner, on instructions, does not press the present petition. He, however, states that it be clarified that the abovesaid opportunity would be the last and final one. He also submits that This is a digitally signed order. CRL.M.C. 5850/2026

since charge-sheet is for offences under Sections 354A/506/509/323/341/34 IPC, the learned Trial Court may be requested to use the facility of Vulnerable Witness Deposition Courtroom for recording her further deposition.

¶5In view of the above, the present application is, hereby, disposed of as not pressed. Needless to say, accused concerned would not be entitled to any further opportunity.

¶6This Court expects that the learned Trial Court keeping in mind the nature of the allegations appearing in the present matter, use the abovesaid facility of Vulnerable Witness Deposition Complex for the purposes of recording testimony of the complainant.

¶7The petition stands disposed of accordingly.

¶8A copy of this order be sent to learned Trial Court for information and due compliance.

¶9Registry is directed to send copy of this order to respondent Nos.2 and 3 through their counsel on his e-mail id.

¶10Pending applications also stand disposed of.
