¶1For the reasons stated in the application, the same is allowed and the delay of 159 days in re-filing the petition stands condoned.

¶1The relief prayed in the instant case is as under: "(It is, therefore, most humbly prayed that the FIR No. 341/2023, P.S. Hauz Qazi, U/s. 354B/354/323/509/34 IPC and other proceedings arising therefrom in case titled as State Vs. Lakshay, pending in the court of Ms. Shaina Goyal, JMFC (Mahila Court), (Central), Tis Hazari Courts, Delhi, may kindly be quashed against the Petitioner." This is a digitally signed order. 2. The parties in both the afore-captioned petitions are present before the Court. They have been identified by the Investigating Officer of the case as well as by their respective counsel.

¶3The present FIR is a counter FIR of the FIR No.340/2023, which has already been set aside by this Court vide order dated 17.08.2026 in W.P.(Crl) 2491/2026.

¶4In view of the settlement, the writ petition also deserves to be quashed.

¶5In view of the aforesaid, FIR No.0321/2018 dated 28.10.2018 under Section 498A/406/354/34 Indian Penal Code, 1860 registered at police station Najafgarh, New Delhi stands quashed along with all proceedings emanating therefrom.
