¶1This hearing has been done through hybrid mode.
¶2The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking issuance of an appropriate writ directing the Respondent to permit the Petitioner to sell ladies wear and cosmetic items instead of 'Mehndi Shop' as mentioned in the Certificate of Vending (hereinafter, 'CoV') issued to the Petitioner by the New Delhi Municipal Council (hereinafter, 'NDMC').
¶3The Petitioner is a provisional CoV holder, who has been issued a CoV This is a digitally signed order. bearing Vendor ID No. V2025200897 under the category 'Mehndi Shop' in Gole Market.
¶4The prayer of the Petitioner is that since the earnings of the Petitioner are insufficient and therefore, she wishes to also sell ladies wear and cosmetic items. For the said purpose, she has made a representation to the Respondent for considering the change of the category in the CoV.
¶5In the opinion of this Court, the change of category would have to be in terms of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and the same would have to be considered by the Town Vending Committee-II, upon being constituted.
¶6Accordingly, let the Town Vending Committee-II consider the representation dated 11th May, 2026 of the Petitioner and take a decision within three months after being constituted.
¶7The petition is disposed of in the above terms. Pending applications, if any, are also disposed of.
