¶1Allowed, subject to all just exceptions.

¶2The present writ petition has been filed seeking the following relief:

¶3The petitioner had earlier approached this Court vide W.P.(C) 11209/2026 which was disposed of by this Court vide order dated 7th The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. August, 2026. The operative part of the order is set out below:

¶4In terms of the said order, respondent/MCD has issued a vacation notice in respect of fourth floor of the subject property.

¶5As noted above, in the appeal filed by the petitioner before Appellate Tribunal MCD ('ATMCD'), no interim protection has been given in respect of construction of the fourth floor. Therefore, there is no infirmity in the action taken by the respondent/MCD. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

¶6Accordingly, the present writ petition is dismissed.
