¶1The Petitioner claims rights in respect of Plot No. 654, admeasuring 150 sq. yds., comprised in Khasra No. 92, situated in the revenue estate of Village Khichripur, Delhi. The said land was acquired pursuant to Award No. 30A/70-71 dated 14th March, 1977. The Petitioner states that neither she nor her predecessor-in-interest sought a reference under Section 18 of the Land Acquisition Act, 1894 ("Act"). This is a digitally signed order. 2. The Petitioner has thereafter approached the Land Acquisition Collector (East) ("LAC") under Section 28A of the Act seeking re-determination of compensation. The said application, filed on 11th August, 2025 and received vide Diary No. 83936, remains pending consideration.

¶3The legal position that Section 28A of the Act enables a person who had not sought a reference under Section 18 to seek re-determination of compensation on the basis of an award of the Court enhancing the amount of compensation is not in dispute. The Petitioner relies upon the judgment of a Division Bench of this Court in Bedi Ram v. Union of India,1 in support of her claim for re-determination of compensation.

¶4Counsel for the Petitioner confines the relief sought in the present petition to a direction to the LAC to consider and decide the aforesaid application under Section 28A of the Act.

¶5In view of the above, the present petition is disposed of with a direction to the LAC to consider and decide the Petitioner's application dated 11th August, 2025, in accordance with law, within a period of three months from today.

¶6It is clarified that this Court has not expressed any opinion on the merits or maintainability of the Petitioner's claim. All rights and contentions of the parties are left open.

¶7The petition is disposed of in the above terms, along with the pending application(s).
