¶1This hearing has been done through hybrid mode.

¶2The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of FIR No. 0129/2026, registered at Police Station Najafgarh, Delhi, for the commission of offences punishable under Sections 85/3(5) of Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS') and all consequential proceedings emanating therefrom on the basis of settlement entered into by the parties.

¶5Brief facts of the case are that Petitioner No.1 and Respondent No.2, got married on 06.09.2024. Thereafter, disputes arose between the parties, pursuant to which Respondent No.2 lodged the present FIR No. 0129/2026 at Police Station Najafgarh under Sections 85/3(5) BNS against the petitioners. Petitioner No.1 also instituted proceedings under Section 11 of the Hindu Marriage Act seeking declaration of nullity of the purported marriage, which are stated to be pending before the learned Family Court. Petitioner Nos.2 to 4 had earlier approached this Court seeking quashing of the FIR on merits. During the pendency of the proceedings, Petitioner No.1 and Respondent No.2 amicably resolved their disputes and executed a Memorandum of Understanding dated 29.07.2026.

¶6On a query made by this Court, Respondent No. 2 categorically states that she has entered into the settlement dated 29.07.2026 with the petitioners voluntarily, out of her own free will and without any force, coercion, undue influence or pressure. She further states that she has no grievance remaining against the petitioners and has no objection to the quashing of FIR No. 0129/2026, registered at Police Station Najafgarh, and all consequential proceedings emanating therefrom.

¶7In view of the fact that the parties have amicably resolved their disputes, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only result in unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.

¶8Accordingly, FIR No. 0129/2026, registered at Police Station The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
