¶1This hearing has been done through hybrid mode.
¶2The present petition has been filed by the Petitioner under Article 226 of the Constitution of India, inter alia, seeking directions to the Respondents to allow the Petitioner to peacefully vend from the vending site on the Footpath/Open Space opposite Vishwa Sadan Building, near Satyam Cinema, District Center, Janakpuri, West Zone, Ward-S-15, New Delhi (hereinafter, 'the vending site').
¶3The case of the Petitioner is that he is a street vendor who has been vending from the said vending site for several years.
¶4The Petitioner has been issued a provisional Certificate of Vending (hereinafter, 'CoV') bearing URI No. 2337592 under the category of 'Food snack with gas cylinder/fire' for West Zone, Ward-S-15, New Delhi.
¶5The photograph of Petitioner's vend has been placed on record and is set out below:
¶6The grievance of the Petitioner is that his cart was removed on 22nd July, 2026, and the Municipal Corporation of Delhi (hereinafter, 'MCD') has imposed a fine of Rs.10,000/- for returning the cart and all the perishable items.
¶7Further, it is also submitted by Mr. Aditya, ld. Counsel for the Petitioner that he is not being permitted to peacefully vend from the vending site, and his vending activities have been obstructed by the concerned officials of the MCD and Delhi Police.
¶8On the other hand, Ms. Shilpa Ohri, ld. Additional Standing Counsel for the MCD, submits that the Petitioner is vending inside the District Centre, Janakpuri and is also not vending in terms of his provisional CoV.
¶9Further, it is also submitted by ld. ASC that the Petitioner is selling fruit juices, sliced fruits, etc., for which a separate licence is required, whereas the Petitioner was only permitted to sell food/snack items in terms of the provisional CoV, which does not include cut fruits.
¶10Furthermore, it is also contended that the Petitioner was also not maintaining cleanliness and hygiene, and was encroaching on the footpath of the said area.
¶11Thus, it is the case of the MCD that a special encroachment drive was undertaken to remove the vendors from the footpath.
¶12The Court has heard the ld. Counsels for the parties. The photographs placed on record by the MCD have been extracted below:
¶13A perusal of the above photographs would, in fact, show that there is enormous litter at the site and that the Petitioner was not abiding by the terms and conditions of the provisional CoV.
¶14Under these circumstances, the Court is not inclined to interfere with the removal of the cart or the imposition of the fine upon the Petitioner. However, since the Petitioner is in possession of a provisional CoV, he is permitted to vend strictly in accordance with the terms and conditions stipulated therein, within the West Zone, Ward S-15.
¶15Further, since the category of the Petitioner is 'Food/Snack Gas Cylinder with Fire', the Petitioner shall also abide by similar terms and conditions as have been passed in similar matters, where vendors were vending under the category of 'Food/Snack with gas cylinder/fire' i.e., in W.P.(C) 15082/2025 titled 'Rajendra Singh v. Commissioner of Police and Ors.' vide order dated 2nd February, 2026, W.P.(C) 19391/2025 titled 'Mohd Badruddin v. Municipal Corporation of Delhi & Ors.' vide order dated 8th January, 2026 and in W.P. (C) 1609/2026 titled 'Rihana v. MCD & Ors.' vide order dated 5th February, 2026.
