07.10.2010 The captioned application has been jointly prefened by the plaintiffs and the defendant under the provisions of Order 23 Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 (in short 'CPC') to bring on record the terms of settlement arrived at between them. The captioned application is marked as Exhibit 'X'. The captioned application (Exhibit 'X') bears the signatures of the constituted attorney of the plaintiffs and that of Mr Jignesh Damjibhai Patel, the proprietor of the defendant concern. The I captioned application (Exhibit 'X') also bears the signatures of the advocates representing the parties in the instant suit. In addition, the captioned application (Exhibit 'X') is accompanied by the affidavit of the constituted attorney of the plaintiffs as also that of Mr Jignesh Damjibhai Patel, the proprietor of the defendant concern. The suit is decreed in terms of Paragraphs 28(i) to (iii) of the plaint. The undertakings given by the defendants are accepted. A decree sheet be drawn up accordingly. The captioned application (Exhibit 'X') shall form part of the decree. The captioned application and the suit are disposed of accordingly. The suit be consigned to record.
