¶6The Petitioners and Respondent No.2 are present before this Court and have been identified by the Investigating Officer (IO) concerned.
¶7Briefly stated, the marriage between Petitioner No. 1 and Respondent No. 2 was solemnized on 09.07.2011 in accordance with Hindu rites and ceremonies. Out of the said wedlock, a male child, namely Deepak @ Daksh, was born on 17.10.2013. Owing to matrimonial discord and differences between the parties, disputes arose between them, resulting in the registration of the present FIR and other connected proceedings.
¶8During the pendency of the proceedings, with the intervention of family members and well-wishers, the parties amicably resolved all their matrimonial disputes and claims and entered into a Memorandum of Understanding/Settlement. In terms of the settlement, the parties agreed to dissolve their marriage by mutual consent under Section 13-B of the Hindu Marriage Act, 1955 and to bring an end to the criminal and other proceedings arising out of their matrimonial disputes.
¶9Learned counsel for the petitioners submits that, in terms of the settlement, the parties agreed to settle all their disputes for a total sum of Rs. 5,00,000/- (Rupees Five Lakhs only) towards full and final settlement of the claims of Respondent No. 2, including her claims towards istridhan, maintenance and other matrimonial claims. It is submitted that a sum of Rs. 50,000/- was paid to Respondent No. 2 on 12.09.2025. A further sum of Rs. 1,50,000/- was paid at the time of recording of the statements of the parties at the stage of the first motion on 10.02.2026, and another sum of Rs. ¶10It is further submitted that the balance amount of Rs. 1,50,000/- (Rupees One Lakh and Fifty Thousand only) has been handed over to Respondent No. 2 today in Court by way of Demand Draft bearing No. 742903. It is submitted that, with the said payment, the terms and conditions of the settlement stand fully complied with and nothing further remains to be paid by either party under the settlement.
¶11On a query made by this Court, Respondent No. 2, who has been duly identified by the Investigating Officer, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed.
¶12It is also brought to the notice of this Court that one of the co-accused, namely Sh. Nand Kishor, had expired on 26.02.2023.
¶13In view of the fact that the dispute between the parties is essentially matrimonial and private in nature, the parties have amicably resolved all their disputes and claims, the terms and conditions of the settlement have been fully complied with, the entire settled amount has been paid to Respondent No. 2, and Respondent No. 2 has no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties.
¶14Accordingly, FIR No. 699/2015, registered at Police Station Rani The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Bagh, Delhi, for the offences punishable under Sections 498A/406/34 of the IPC, and all consequential proceedings emanating therefrom, are hereby quashed.
