Judgment
ORDER
19.10.2012 The petitioner is in custody since December, 2010. The learned counsel for the petitioner has stated that the trial is I at the penultimate stage and, therefore, the bail may not be granted to the petitioner. As againstthis, the allegationagainst the petitionerare stated to be that he is the part of the gang who had committed robbery within a span of two hrs. from two different persons and both the victims were deprived of their cash, identity cards and mobiles. The petitioneris charged u/S 392/397 IPG but only a mobile is purported to have been recovered from him. No doubt, the allegations against the petitioner are very serious in nature however, having regard to the fact that the petitioner is in custody for almost about 2 years and the material witnesses have already been examined and the fact that he is married and thus has roots in the society, I am inclined to release the petitioner on bail. The petitioner is admitted to bail on his furnishing a personal bond in the su^ sureties for a sum of ^25,000/-each,'^subjectto the following conditions:-
(i) The petitioner shall not threaten the witnesses who have testified against him;
(ii) He shall be present on each and every date of hearing when the matter is taken up before the trial court;
(iii) He shall not commit any further offence;
(iv) He shall not change his place of residence without the permission of the Court.
¶4With the above directions, the bail applications are disposed of.
