¶1This is a petition filed under section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS") seeking quashing of FIR No. 547/2020 dated 16.06.2020 under section 313 of IPC registered at Police Station – Uttam Nagar, New Delhi and proceedings emanating therefrom.

¶2It is stated that the aforesaid FIR was registered in a heat of the moment and based on misunderstanding.

¶3The petitioner and respondent No. 2 are husband and wife and are living together happily. Both the petitioner and respondent No. 2 are present in Court and have been identified by their counsel respective counsels.

¶4It is submitted that the parties have arrived at settlement dated

05.08.2024. Both the parties state that they have entered into the aforesaid settlement out of their own free will, volition and without any threat, force, undue influence or coercion.

¶5The respondent No. 2 states that she does not wish to prosecute the This is a digitally signed order. aforesaid FIR any further and the same may be quashed.

¶6I am satisfied that the matter has been settled and the settlement is lawful. Since the parties have arrived at a settlement and no disputes are pending, I am convinced that quashing of such proceedings on account of settlement would bring about peace and would secure ends of justice. The Court does not see any fruitful purpose if criminal proceedings are permitted to be prosecuted any further.

¶7In this view of the matter, there are no reasons to continue the proceedings. For the said reasons, the FIR No. 547/2020 dated 16.06.2020 under section 313 of IPC registered at Police Station – Uttam Nagar, New Delhi and the consequential proceedings emanating therefrom are hereby quashed.

¶8The petition is disposed of accordingly.
