21.08.2026 Though no one is present on behalf of the defendant when the matter is called-out, learned counsel for the plaintiffs submits that the defendant has performed the terms of the settlement. Accordingly, counsel seeks disposal of the suit, in terms of mediated settlement agreement dated 09.07.2026. A copy of the mediated settlement agreement is on record.
¶2This court has perused the terms of the settlement dated 09.07.2026 and is satisfied that the parties have resolved their inter-se disputes by way of a lawful agreement.
¶3The parties are directed to remain bound by said terms. This is a digitally signed order. CS(COMM) 856/2025
¶4Accordingly, the suit is decreed in favour of plaintiff No.2 and against the defendant in accordance with the terms contained in the settlement agreement.
¶5The Registry is directed to draw-up a decree sheet. The terms of settlement shall form part of the decree.
¶6The suit is decreed and disposed-of in the above terms.
¶7Pending applications, if any, also stand disposed-of.
¶8At this stage, learned counsel appearing for the plaintiffs seeks refund of the entire court-fee.
¶9The matter is at a preliminary stage; and pleadings are not yet complete.
¶10In view of the Court Fees (Delhi Amendment) Act, 2026 which came into effect on 06.03.2026, section 16-A of the Court Fees Act, 1870 (as was applicable to Delhi) has been omitted. Accordingly, section 16 of the Court-fees Act, 1870 would be applicable, which allows for refund of the entire amount of court fee affixed on the plaint.
¶11However, considering that the suit has been pending since 2022, the Registry is directed to draw-up the requisite certificate in favour of plaintiff No.2 for refund of the half court fee affixed on the plaint within 04 weeks from today. A. J. BHAMBHANI, J AUGUST 21, 2026/ak This is a digitally signed order.
