¶1The Petitioner challenges the order dated 14.08.2025, passed by the learned Family Court, directing the petitioner to pay ad-interim maintenance of ₹10,000/- per month to the respondent.

¶2Undisputedly, the application seeking interim maintenance is still pending before the learned Trial Court. The order on ad-interim maintenance was passed by the learned Trial Court considering the emergent need of the wife for securing the maintenance amount as it was submitted that she has no source of income and is not gainfully employed.

¶3In the present case, it has not been disputed that the respondent is the wife of the petitioner herein and the petitioner is working with Tata Consultancy Services and is stated to be earning monthly salary of ₹57,306/-as per salary slip of December, 2024.

¶4Clearly, the impugned order is only an ad-interim order. It This is a digitally signed order. is not disputed that the application for relief of interim maintenance is still pending consideration before the learned Family Court. In such circumstances, any petition under Section 397 of Cr.P.C., challenging the interlocutory order would not be maintainable at this stage.

¶5In above circumstances, I find not infirmity in the order passed by the learned Family Court granting ad-interim maintenance of ₹10,000/- per month.

¶6The petition is, therefore, dismissed. Pending applications, if any, also stand disposed of. AMIT MAHAJAN, J NOVEMBER 17, 2025 "SK" This is a digitally signed order.
