11.11.2011 Petitioner is seeking transfer of Civil Suit No. 179/2006 titled as Islammuddin & Ors. Vs. Miraiuddian & Ors. which is a suit for partition and mandatory injunction pending before East District Karkardoom to the Tis Hazari on the contention that the immovable property which is the subject matter of the suit is situated at Darya Ganj; as such the territorial jurisdiction would lie with the Tis Hazari Courts. Relevant would it be to state that before the notification dated 22.10.2008 of the Delhi High Court, the distribution of work of the District Courts was not jurisdiction wise; suits were not being filed and earmarked in terms of jurisdiction; there were three only court complexes functioning at Tis Hazari Courts, Karkardooma Courts and Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. Patiala House Courts. This suit was filed in the year 2004 at which time there was no bifurcation of the work jurisdiction wise. In view of the above the suit which is pending before the concerned court i.e. the East District shall continue there and the cpncerned court shall proceed to deal with the case on its merits.
