It is not disputed that before the Estate Officer, the petitioner had raised a plea that in respect ofdamagespertainingto thegoodsin issue, the matter was covered by an arbitration agreement between the parties. The EstateOfficeradmittedlyvide order dated22.02.2013 rejectedthe plea. Againstthe said orderofthe Estate Officer, appeals have been preferred before the District Judge, being: PPA No.2/2013 and PPA No.3/2013. The appeals admittedly,inter alia,pertainto the issue whicharises in thepresentpetitionsi.e., that the dispute is covered by the arbitration agreement. I am told that the appeals are coming up beforetheDistrictJudge on14.08.2013. The learned counsel for thepetitionersays that the District Judge is not holding the court for quite some time. The counsel for therespondenton the other hand says that on threeoccasions, applicationsforstayhavebeenfiledbeforetheDistrictJudge,which weredismissed. Havingregardto theaforesaidfactsandcircumstances,Iamof theview thatthepetitions arepremature andare accordingly dismissed.
