Crl.M.C.No.2360/2008
Statement of respondent No.2 has been recorded. The respondent No.2 has received the amount of Rs.35,000/- in cash today in the court in settlement of his claims against the petitioner and he does not want that the proceedings should continue pursuant to the FIR No.425/2003 under Sections 406/34 of IPC registered at Police Station Welcome. It shall also be in the interest of justice that the said FIR and all the proceeding emanating therefrom are quashed. Learned counsel for the State, Mr.Vats, also has no objection in case the FIR is quashed.
Considering the facts and in totality of circumstances, as no useful purpose shall be served in continuing the proceedings pursuant FIR No.425/2003 under Sections 406/34 of IPC registered at Police Station Welcome and it will also be in the interest of justice to quash the FIR and all the proceedings emanating therefrom.
Consequently, the FIR No.425/2003 under Sections 406/34 of IPC registered at Police Station Welcome and all the proceedings emanating therefrom are quashed.
The petition is disposed of with these directions. Dasti.
