Case no.
CRL.M.C. 3129/2010

Judgment

• ) # %. 30.09.2010 Present: Mr. Umesh Singh, Adv. for the petitioner. Mr. M.P. Singh, APP for the State along with SI Jai Nath, P.S. Prasad Nagar. Mr. R.S. Saini, Adv. for respondent no2 along with respondent no. 2 in person. +Crl. M.A. 15840/2010 * Allowed, subject to all just exceptions. Application stands disposed of. +CrLM.C.3129/2010 Petitioner is the son of the complainant/respondent no.2. It appears that a quarrel took place between them wherein out of anger petitioner hit respondent no. 2 by "iron rapi" which resulted in injuries on the person of the complainant. Accordingly, FIR No. 135/2009 under Sections 324 I 326 IPC was registered at Police Station Prasad Nagar against the petitioner. It is stated that petitioner is in judicial custody for the last fourteen months. Now, respondent no.2 has compromised the matter with the petitioner. Terms of settlement have been recorded in settlement deed dated 28th August, 2010. Respondent no.2 has pardoned the misdeeds of the petitioner. Respondent no. 2, who is present in the Court, stated that he has no objection if the FIR is quashed. Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. r Keeping in mind that settlement has been arrived at between the parties, I am of the view that no fruitful purpose would be served in compelling the parties to continue to litigate protracted trial. Accordingly, in larger interest, FIR No. 135/2009 under Sections IPC registered at Police Station Prasad and consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Dasti. September 30, 2010 ga
