Through: Mr. Rakesh Kumar Singh, Advocate versus Judgment DebtorP & R OVERSEAS PVT.LTD? Through: Mr. H.P. Singh and Mr. Navroop Singh, Advocates CORAM: JUSTICE SHIV NARAYAN DHINGRA WI ORDER?
09.02.2009% It is submitted by counsel for JD that the decree holder was to pay Rs.4 lac by way of demand draft on account of existing stock of the JD but this amount has not been paid in terms of the compromise entered into between the parties. Keeping in view the fact that the Decree Holder has failed to honour the compromise entered into between the parties, JD is at liberty to sell the stock already lying with the JD at the prevalent market price. It is made clear that selling of these goods shall not tantamount to any infringement. This petition stands disposed of in above terms.
