M.C. 2762/2010 Petitioners were working with M/s Piccadily Hotels Pvt. Ltd. Respondent no. 2 is working as Chief Finance Officer with the said hotel. Petitioners had misappropriated about lakhs of their employer. On the complaint of respondent no. 2, FIR in question was registered under Section 408 IPC at Police Station Tilak Nagar against the petitioners. Now, petitioners and respondent no. 2 have settled their disputes amicably inasmuch as, petitioners have refunded sum of lakhs to respondent no. 2. Respondent no. 2 has no objection if the FIR in question is quashed. Since, both the parties have settled their disputes out of court, am of the view that no fruitful purpose would be served in Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. compelling the parties to continue to litigate a protracted trial. Accordingly, in larger interest, FIR No. 152/2010 under Section 408 IPC registered at Police Station Tilak Nagar and consequent proceedings emanating therefrom are quashed. However, cost of each is imposed on the petitioners which shall be deposited with the Delhi High Court Legal Services Committee within two weeks. Petition is disposed of in the above terms. Dasti.
