24.07.2012 Mr. R.K. Gupta, counsel appearing for Respondent Nos. 1 to 3 submits that the Respondents will hand over possession of flats to the Petitioners herein Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. subject to their undertaking that they will not transfer the flats and, would also be willing to pay the enhanced cost, if so held to be liable by the Supreme Court in the pending Review Petition No. 756/2012; pending adjudication of the matter in the Supreme Court. Ms. Amita Gupta, on instructions from the Petitioners, submits that she is willing to undertake in the aforesaid terms on behalf of the Petitioners, who are present in Court today. The said undertaking of the Petitioners, who are present in Court is taken note of. Accordingly, the Respondents are directed to hand over the possession of the flats to the Petitioners on 31'^ July, 2012 at 11.00 a.m. The Petitioners shall remain present at the site on 3 July, 2012 at the stated time. It is also made clear that the enhanced cost, if any, payable pursuant to any order that may be passed by the Supreme Court shall be the first charge on the said flats. Having regard to afore-mentioned directions, the counsel for the Petitioners submits that she does not wish to press the present contempt petitions. It is ordered accordingly.
