Rohini. +Crl.M.C. 3056/2010 This is a petition seeking quashing of FIR No.497/2007 under Sections 498A/406/34 IPG registered at P.S. Rohini against petitioner nos.1 to 4 by petitioner no.5. The ground for seeking quashing is that FIR was the result of matrimonial discord which has, been amicably settled and now there is no dispute left between the parties. True copy of the settlement is placed on record which is purportedly signed by petitioner no.5 also and this fact is verified by her. Petitioner nos.1 to 4 are present and they are identified by their counsel Shri Y.N. Sengar, Advocate. Petitioner no.5 is present in person and she is identified by Shri Y.N. Sengar, Advocate and Investigating Officer. Parties confirm that they have arrived at an amicable settlement and now there is no dispute left between them. The terms of settlement are placed at page 37 of the paper book. Petitioner no.5 submits that she has arrived at the settlement with the petitioners of her own accord without any inducement or threat from any corner. She further submits that pursuant to the settlement arrived at between the parties, there is no dispute left between her and petitioner nos.1 to 4. She states that in view of the settlement, she does not want any action against petitioner no.1 to 4 on her FIR and requests for quashing of the same. Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. Learned APP submits that in view of the fact that parties have arrived at an amicable settlement, the State has no objection if the FIR as well as proceedings arising out of the same are quashed. Since the parties have arrived at an amicable settlement of their dispute arising out of the matrimonial discord, no useful purpose shall be served by keeping the FIR as well as the proceedings arising out of same alive. Accordingly FIR No.497/2007, P.S. Rohini as well as the proceedings arising out of the same is quashed. The petition is disposed of. AJIT BHARIHOKE (JUDGE) SEPTEMBER 29, 2010 gm
