Judgment
ORDER 0;(1
30.09.2010 Crl. M.A. No.l5821/?010 in Crl. M.C No.3117/2010 Crl. in Crl. M.C. No.3138/20_10 Exemptions allowed, subject to all just exceptions. Crl. M-=-c;. No.3117/2010. Crl. M.C No).l38/2Ql_Q I have heard the statement made by respondent No.2, who is present with her father. I have also examined the allegations made in the FIRs. Matrimonial discord has resulted in filing of the criminal proceedings. Atter a long dispute lasting over 1 0 years, parties have entered into a settlement and have executed a settlement deed dated 28th September, 2010. ln terms of the compromise/settlement deed, Rs.6,00,000/- (Rupees Six lacs) has been paid to respondent No.2 today in Court by way of three demand drafts bearing No.075087 for Rs.3,00,000/- (Rupees Three Lacs) drawn on HDFC Bank Ranchi, 695736 for Rs.2,00,000/- (Rupees Two Lacs) drawn on Canara Bank, 695735 for Rs.l,OO,OOO/-(Rupees One Lac) drawn on Canara Bank. She r.as accepted the said demand drafts. Further payment ofRs.2,00,000/- (Rupees Two Lacs) is to be made when the respondent No.2 withdraws her application for setting aside of the ex-parte decree of divorce. Certify that the digital file and physical file have been compared and the digital data is as per the physical file and no page is missing. f' • The parties have decided to forget the past ditierence and have resolved their differences. I do not think in these circumstances prosecution proceedings should be allowed to continue. It is in the interest of justice that the prosecution proceedings should be quashed. It is pointed out that offences under Sections 323, 341 and 354 IPC are compoundable. Accordingly, the present petitions are allowed and the FIR No.252/2000 Police Station Vasant Kunj and FIR No.459/1999 Police Station Vasant Kunj and the proceedings emanating therefrom are hereby set aside and quashed.
