15.11.2011 This is a petition against an order dated 5"^ November, 2011 whereby the order was passed for issuance of NBWs against the petitioners/accused and notices to the sureties under section 446 CrPC for December, 2011. I have perused the impugned order and heard the learned counsel for the petitioners and learned APP for the State. Learned counsel for the petitioner has shown medical certificates of the petitioners and a proof regarding the accident. Having regard to this fact, the impugned order is set aside. Consequently, the NBWs issued against the accused/petitioners and notices to the sureties under Sec. 446, are withdrawn. The petitioners undertake to appear before the trial court on 3'"^ December, 2011 the date already fixed.
